Terms & Conditions
The rules for using this website, and the general terms behind a development engagement. Project-specific commercial terms live in the agreement, not here.
Last updatedApplies to aarnainfo.com
These terms apply to your use of aarnainfo.com and to the general basis on which Aarna Info provides its services. They are not a project contract. Where a quotation, proposal, statement of work or signed agreement exists, that document sets the commercial terms and prevails over this page wherever the two differ.
Acceptance
Using this website constitutes acceptance. If you do not accept them, do not use the site. The page is revised periodically; the version in force is whichever was published here on the date of your visit.
Acceptable use
You may read, print and share these pages for your own reference or to evaluate engaging us. You may not:
- Attempt unauthorised access to the site, its hosting, its source or any connected system.
- Probe, scan, scrape or test it so as to degrade availability for others.
- Introduce malicious code or anything intended to disrupt or damage the site or its visitors.
- Reproduce, republish or sell a substantial part of it, or present our material as your own work.
- Submit false information, impersonate another person, or use the form for unsolicited commercial messages.
- Use the site in breach of any applicable law or regulation.
Access may be restricted or withdrawn where we judge it necessary to protect the site, its visitors or the business.
No offer, no published price
Descriptions of services, technologies and methods here are informational. Nothing constitutes an offer capable of acceptance, a quotation, a price, an estimate of cost or duration, or an undertaking that particular work can be accepted. Neither prices nor delivery dates appear anywhere on this site, because neither can be stated sensibly before a brief has been read. An engagement begins when scope is agreed in writing and a quotation, proposal or contract is accepted by both parties.
Enquiries
An enquiry by form or email creates no obligation on either party. We may decline an enquiry or decline to quote without reason. A proposal or estimate is based on the information available when written, is valid for the period that document states, and may be revised if the requirement proves different from its description. How we handle the personal information in an enquiry is set out in our Privacy Policy.
Scope
What is built, what it does, what is included and what is expressly excluded are defined in the applicable proposal or statement of work. Anything that document does not describe falls outside the agreed scope. Requirements emerging later are handled as changes, not assumed to be included.
Fees and payment
Fees are quoted per project or engagement. The applicable document states the fee, its coverage, the milestones, the invoicing schedule, the currency and applicable taxes. Taxes and statutory levies are payable in addition unless stated otherwise. Bank charges and foreign-exchange costs are borne by the payer. Where an invoice is unpaid beyond the agreed period, work may be paused and delivery withheld until the account is settled.
No payment is taken through this website. There is no cart, checkout or payment gateway, and card details will never be requested by email or through the enquiry form.
Client obligations
A project depends on both parties. Engaging us, you agree to:
- Provide accurate requirements and notify changes promptly.
- Supply content, brand assets, data and other required material, confirming you hold the rights to it.
- Provide necessary access — repositories, hosting, developer accounts, domains, test devices — in your own name where a platform requires it.
- Keep credentials secure and revoke access once it is no longer required.
- Nominate a person able to answer questions and decide on your behalf.
- Review deliverables and return consolidated feedback and approvals, so work is not blocked awaiting a decision.
- Meet obligations imposed by your regulator, platform or industry on the software you publish.
Where delay results from information, access or approval not reaching us, the schedule and any cost consequence are adjusted under the applicable agreement.
Changes
Requirements move; that is expected. Anything adding to, removing from or materially altering the agreed scope is a change. Its effect on effort, cost and schedule is set out in writing and implemented on your confirmation. Until confirmed, work continues on the existing scope.
Delivery and acceptance
Dates in a proposal are good-faith estimates based on the scope known at the time and on your dependencies arriving as planned. They are not guarantees, and no timeline is published on this site. Deliverables are submitted for review as the applicable agreement describes, which also defines the review period, acceptance criteria and the handling of reported defects.
Intellectual property
The site
The text, layout, design, graphics, illustrations and code comprising this website belong to Aarna Info or are used under licence, and are protected by copyright and related law. Reading, printing and sharing are permitted; republishing a substantial part, or presenting our material as your own, is not.
Commissioned work
Rights in deliverables created specifically for you are assigned or licensed on the terms of the applicable agreement, normally on payment of the fees for that work in full. Until then they remain ours. We may describe the type of work in general terms, but will not publish your name, materials or confidential details without written permission.
Pre-existing material
Ownership of our own pre-existing material is retained: tools, frameworks, libraries, code patterns, templates, scripts and general know-how, along with anything of that nature developed or improved while working for you. Where such material is embedded in a deliverable, you receive the licence required to use, run and modify that deliverable for its intended purpose. Nothing in an engagement restricts our use of general skills, experience and techniques elsewhere.
Third-party components
Most software incorporates third-party components: open-source and commercial libraries, SDKs, fonts, plugins, cloud services and APIs. Each is governed by its supplier's licence, which applies to you as the user of the finished software. Where a component carries a recurring fee, subscription or per-seat licence, that cost is yours unless the agreement states otherwise, and the account is normally held in your name.
Confidentiality
Each party may learn confidential information about the other: business plans, data, source code, pricing, technical material. Neither will disclose it to anyone who does not need it for the work, nor use it outside the engagement. The obligation excludes information already public without breach, already known, independently developed, or required to be disclosed by law or a competent authority, and it continues after the engagement ends.
Third-party platforms
Projects depend on services we do not control: application stores, cloud platforms, payment gateways, mapping and notification services, analytics providers. Each is governed by its provider's terms, which you accept directly. We are not responsible for decisions such a provider takes \u2014 a review outcome, account suspension, policy or pricing change, feature deprecation, or outage. Where a platform changes its requirements after delivery, restoring compliance is new work.
Maintenance
Maintenance, support, hosting and monitoring are separate from development and are provided only where the applicable agreement provides for them. That document defines coverage, how requests are raised and how they are prioritised. Absent such an arrangement there is no continuing obligation to monitor, update or maintain delivered software, though you may always request a quote for further work.
Warranties
We warrant that services will be performed with reasonable skill and care by persons competent to carry out the work, and that deliverables will conform in all material respects to the specification agreed in writing. We do not warrant uninterrupted or error-free operation, that every defect is correctable, compatibility with every device, browser or operating system including future versions, or any particular commercial result. To the extent the law permits, all other warranties, conditions and terms implied by statute or otherwise are excluded.
Limitation of liability
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation. Subject to that:
- We are not liable for indirect or consequential loss, nor for loss of profit, revenue, business, goodwill or anticipated savings, nor for loss or corruption of data, however arising.
- Total liability in connection with an engagement is limited to the cap stated in the applicable agreement or, where silent, to the fees actually paid for the specific work giving rise to the claim.
- The website is provided as it is. Use of it, and reliance on anything published here, is at your own risk \u2014 see the Disclaimer.
Indemnity
You agree to indemnify us against claims, losses, liabilities and reasonable costs arising from content, data, materials or instructions you supply, from use of a deliverable otherwise than as agreed, from your breach of these terms, or from your breach of a third-party licence or platform policy.
Suspension and termination
Either party may end an engagement in the manner the applicable agreement describes. We may suspend work where an invoice is overdue, where required access or information is not forthcoming, or where continuing would breach a law or platform policy. On termination, work already performed and costs properly incurred remain payable; each party returns or deletes the other's confidential material on request except where a copy must be retained for legal reasons; and the provisions intended to survive continue to apply. Cancellation and refunds are dealt with in our Refund & Cancellation Policy.
Force majeure
Neither party is liable for delay or failure caused by matters beyond its reasonable control: natural events, fire, flood, epidemic, war, civil disturbance, strike, failure of power, telecommunications or internet infrastructure, cyber attack, or act of government. The affected party will notify the other as soon as reasonably practicable and resume as soon as able.
Governing law
These terms and any engagement under them are governed by the laws of India. The courts at Surat, Gujarathave exclusive jurisdiction over any dispute, save that either party may seek urgent relief elsewhere to protect intellectual property or confidential information. Before commencing proceedings, both parties agree to raise the matter in writing and attempt in good faith to resolve it.
General
- Precedence. Where a signed agreement, contract, statement of work, proposal or quotation deals with a matter covered on this page, that document prevails to the extent of the conflict. Fees, milestones, payment schedule, timelines, scope and deliverables are defined there and nowhere else.
- Entire agreement. The applicable agreement together with these terms is the whole of what has been agreed about its subject matter, and replaces earlier discussion and correspondence about it.
- Severability. If a provision is found to be invalid or unenforceable, it is treated as removed and the rest continues in force.
- No waiver. A delay in enforcing a right is not a waiver of it.
- Assignment. Neither side may transfer its rights or obligations under an engagement without the written consent of the other, which will not be unreasonably withheld.
- Independent contractor. We work as an independent contractor. Nothing in these terms creates a partnership, a joint venture or an employment relationship.
- Notices. Written notice may be given by email to contact@aarnainfo.com, or to the address recorded for you in the applicable agreement.
